Ticketing Terms and Conditions

ENTRY TO THE STADIUM IS SUBJECT TO THE FOLLOWING REGULATIONS

Inverness Caledonian Thistle Football Club Regulations

“Club” means Inverness Thistle & Caledonian F.C. Ltd trading as Inverness Caledonian Thistle F.C. (“ICT FC”)
 
“Event” means any event taking place at the Stadium, including without limitation any football match, concert, meeting or open day.
 
“Event Organiser” means any party authorised by the Club to organise an Event within the Stadium.
 
“Stadium” means Caledonian Stadium and all surrounding areas owned, occupied or utilised by the Club.
 
“Ticket Holder” means any person holding a ticket for the purposes of attending an Event to take place at the Stadium or for any other reason.

1               All football matches played at the Stadium are played in accordance with the Rules and Regulations of The Scottish Football Association, The Scottish Professional Football League, and/or, where applicable, the Regulations of FIFA/UEFA Competitions.  Copies of these Rules and Regulations are available on request from the Club’s Ticket Office.
2               Play cannot be guaranteed to take place on any particular day or at any particular time and the Club reserves the right to change its advertised fixtures without prior notice and without liability.
3               All persons, including children, entering the Stadium must pay for admission or hold a valid ticket.
4               Unauthorised persons are not permitted to enter upon the field of play.
5               With the exception of authorised media representatives holding accreditation issued by the Club/Event Organiser or other persons expressly authorised by the Club/Event Organiser, the taking of photographs or filming by any means inside the Stadium is prohibited.  In addition, no transmission or reproduction, in whole or in part, in any form, or by any means, electronic, mechanical, recording or otherwise is permitted save with a special authorisation in writing by the Club/Event Organiser and, where appropriate, the prior consent of The Scottish Football Association, The Scottish Professional Football League, or appropriate body.   Entry to the Stadium may be denied to any persons with audio, visual and/or audio-visual recording equipment of any sort, including without limitation cameras, video cameras, cassette recorders and microphones.
6               All persons entering the Stadium grant to the Club/Event Organiser and to third parties authorised by the Club/Event Organiser, permission to use photographs, film, tape and other likenesses of spectators without compensation.
7               CCTV cameras are used within the Stadium and recordings could be used by the Club/Event Organiser and police in any proceedings.
8               Only persons specifically authorised in writing by the Club/Event Organiser are permitted to offer newspapers, periodicals, or any other articles for sale in the Stadium.  Persons may not solicit contributions or distribute literature at any Event, or wear or bring political, advertising or other promotional material into the Stadium.  Violators will be subject to ejection from the Stadium and confiscation of the offending material at the discretion of the Club/Event Organiser.
9               Unnecessary noise such as from the use of radio sets and behaviour likely to cause other persons to be alarmed, upset or annoyed or to cause nuisance of any kind is not permitted in any part of the Stadium.
10             The use of threatening behaviour, foul or abusive language is strictly FORBIDDEN. Racial, sectarian, homophobic or discriminatory abuse or chanting is also forbidden and is considered as Unacceptable Conduct and may result in arrest and a lifetime ban from regulated football matches.
11             Please note that it is an offence punishable by law by for any person to enter or attempt to enter the Stadium:
(1)            whilst in possession of a prohibited container which is or was capable of holding liquid and which if thrown would be capable of causing injury to another person;
 
(2)            whilst in possession of alcohol;
 
(3)            whilst drunk;
 
(4)            whilst in possession of any article or substance whose main purposes is the emission of a flare for the purposes of illuminating or signalling or the emission of smoke or a visible gas;
 
(5)            whilst in possession of any article which is a firework,
 
12             All persons entering the Stadium may be searched and any person who refuses to submit to a search will be refused entry to or ejected from the Stadium.
13             Persons under the influence of alcohol or any illegal substance, or in possession of any illegal substance, will be refused entry to or required to leave the Stadium at the sole discretion of the Club/Event Organiser.
14             Standing is FORBIDDEN in seated viewing areas.
15             Banners or other articles that could or might be used as a weapon, or may reasonably be expected to cause annoyance or offence, are not permitted within the Stadium.
16             All persons entering the Stadium are admitted subject to the condition that they may be required to submit to search to prevent prohibited articles being brought into the Stadium which might be used to cause injury or damage to other persons or property.
17             Under no circumstances is it permitted to throw any object whether on to the pitch or track or otherwise.
18             At all times, the right of admission is reserved by the Club/Event Organiser and in general no transfers within the Stadium are prohibited. Spectators found in the wrong area amid opposing fans may be ejected.
19             The wearing of colours and/or regalia of any Football Club other than ICT FC in the Main and North Stand is not permitted. Persons wearing the colours of other Clubs will be refused entry to these areas and if already admitted, will be ejected from the Stadium.
20             All persons are obliged, in the interests of safety, to comply promptly with the instructions of the police, stewards and other authorised personnel.
21             The Club/Event Organiser, its employees or its agents will not be liable for any loss, injury or damage, howsoever caused, to persons entering the Stadium or their property except for liability for death or personal injury resulting from the Club’s/Event Organiser’s negligence. 
22             All persons entering the Stadium undertake to conduct themselves in an orderly and appropriate manner, having regard to the safety, enjoyment and comfort of other persons, including spectators, players and Stadium officials.  In particular, but without prejudice to the foregoing obligation, all persons are obliged not to behave in a manner which may reasonably be expected to cause any persons to be alarmed, upset or annoyed.
23             All persons entering the Stadium are obliged at all times to respect the property of the Club/Event Organiser and other persons within the Stadium. 
24             Without prejudice to the foregoing obligation, all persons are obliged not to behave in a manner which might reasonably be expected to result in the loss, injury or damage to
(1)        The property of the Club/Event Organiser;
(2)        Employees of the Club/Event Organiser and their property; and
(3)        Other persons attending the Stadium and their property.
25             All persons entering the Stadium are admitted only subject to these Regulations and to the Rules and Regulations of the Scottish Football Association and/or the Scottish Professional Football League and/or the Regulations of FIFA/UEFA Competitions, as applicable.  Copies of these Rules and Regulations are available on request from the Club’s Ticket Office and Club Website, www.ictfc.co.uk.  In any case in which these Rules and Regulations are not otherwise applicable, ENTRY TO THE STADIUM SHALL BE DEEMED TO CONSTITUTE UNQUALIFIED ACCEPTANCE OF ALL THESE RULES AND REGULATIONS.
26             ICT FC reserves the right to for its servants, agents and officers of Police Scotland to remove from the Stadium any person who DOES NOT COMPLY WITH THESE REGULATIONS AND WITH THE RULES AND REGULATIONS of The Scottish Football Association, the Scottish Premier League, The Scottish Football League and/or where appropriate the Regulations of FIFA/UEFA Competitions, or whose presence in the Stadium is or could reasonably be construed as constituting a source of danger, nuisance or annoyance to other Spectators.
27             Caledonian Stadium is a no-smoking stadium. Smoking is forbidden in all areas. This includes e-cigarettes and vapes.
28             No refund for match tickets or admission price shall be made, except in the following situations:-
Football Match Postponements
In the event of postponement of the football match prior to entry to the Stadium, the ticket will be valid for the rearranged playing of the match.  Where the match is postponed after entry to the Stadium and before kick-off, entry to the Stadium for the rearranged playing of the match will only be permitted on presentation of the ticket stub, and subject to compliance with any other arrangements as may be announced at the time.  A person who does not wish to attend the rearranged playing of the match shall be entitled to a refund of the face value of the ticket, provided that the application for a refund is received at the Club Ticket Office within 14 days of the announcement of the rearranged match date, enclosing the ticket stub.  
Abandonment of the Football Match after Kick-off (where match to be replayed or rearranged)
In the event of the football match being abandoned after kick-off a person shall be permitted to enter the Stadium for a rearranged fixture on presentation of the ticket stub and subject to compliance with any other arrangements as may be announced at the time.  A person who does not wish to attend the rearranged playing of the match shall be entitled to a refund, the amount of which shall be determined by the Club.  In such an event the refund will only be paid when an application for a refund has been received at the Club Ticket Office within 14 days of the announcement of the rearranged match date, enclosing the ticket stub.  
Cancellation/Abandonment of a Football Match (not to be replayed or rearranged)
 
When a football match is cancelled/abandoned before kick-off a person shall be entitled to a refund of the face value of the ticket, provided that an application for a refund is received at the Club Ticket Office within 14 days of the announcement of the cancellation/abandonment, enclosing the ticket stub.  Where a match is abandoned after kick-off a refund shall be payable, the amount of which shall be determined by the Club.  In such an event the refund will only be paid when an application for refund has been received at the Club Ticket Office within 14 days of the announcement of the cancellation/abandonment, enclosing the ticket stub.
 
In the event of a postponement or abandonment, it is the ticket holder’s responsibility to ascertain the rearranged date and time of kick-off.
 
All applications and correspondence in relation to refunds must be addressed to the Ticket Office, ICTFC, Caledonian Stadium, Stadium Road, Inverness, IV1 1FF.  The name and address for each ticket holder must be supplied in block capitals for a refund to be given.  Please allow 28 days for a refund to be processed.
 
In each of the above cases, a refund shall be made on presentation of the ticket stub.  The Club shall not in any of the above circumstances be liable in any event for any amounts other than the refunds as set out above (including, but not limited to amounts incurred by way of hotel or travel expenses).
 
For the avoidance of doubt, the conditions set out in the Regulations apply to all football matches held at the Stadium, including any postponed or rearranged football matches.
 
Where entry to the Stadium is by use of a Season Ticket, the following conditions 25-37 will also be applicable:-
 
“Season Ticket” means the card including bar code and purchaser’s details
 
29             If any of the conditions detailed in the Regulations are not acceptable to the Season Ticket holder, the Season Ticket should be returned intact to the ICT FC Ticket Office.  In such event a refund will only be paid when an application for refund has been received at the ICT FC Ticket Office within 14 days of purchase, enclosing the Season Ticket.  For the avoidance of doubt, the use of the Ticket to access one or more matches will be considered to constitute acceptance by the Season Ticket holder of all the Regulations.
30             The Season Ticket provides admission only to Scottish Professional Football League football matches under the jurisdiction of ICT FC held at the Stadium during the relevant season.
31             Dates and times of kick off will be announced on the ICT FC website www.ictfc.co.uk, through the local press and/or local radio and/or the ICT FC programme, and may be altered at short notice.
32             The card or QR code must be presented for scanning to the turnstile operator.  Turnstile operators have been given strict instructions to refuse admittance to any person not producing a valid Season Ticket.
33             ICT FC cannot accept responsibility of any kind for Season Tickets lost, defaced or destroyed.  At ICT FC’s discretion, and subject to providing suitable indemnities and assurances to ICT Season Tickets that have been lost, defaced or destroyed may be replaced at a fee of £5.00.
34             The Season Ticket must be produced on demand.
35             No refund will be made in respect of unused Matches.
36             Any Season Ticket holder forgetting to bring his or her Season Ticket to a football match, can obtain a match ticket from the Ticket Office on payment of the appropriate replacement ticket price. 
37             Season Ticket holders will have the opportunity to buy a match ticket for any cup ties, special and friendly football matches for which the Season Ticket is not valid. 
38             All correspondence with the ICT FC Ticket Office in relation to Season Tickets should quote: Section, Row and Seat Number and Personal Number displayed on the Seat Confirmation Ticket.
39             The Season Ticket holder is NOT transferrable.
40             In areas of the Stadium where concessions apply proof of eligibility must be provided.
Where entry to the Stadium is by use of a match ticket, the following conditions 38-47 will also be  applicable: –
41             References in these Regulations to “ticket”, except in Regulation 24 and Regulation 47, shall be deemed to include references to Match Ticket and/or Season Ticket, as appropriate.
42             On entering the Stadium, the ticket holder must retain the ticket until the Event has concluded.
43             The ticket is only valid if presented complete whether for the purposes of gaining entry to the Stadium or otherwise.
44             In areas of the Stadium where concessions apply proof of eligibility must be provided on purchase and must be available at entrance to the stadium.  Failure to satisfy the concession terms will invalidate the ticket.
45             The ticket holder’s attention is drawn to the segregation arrangements for the Stadium as detailed on the ticket. The area for which the ticket provides entry is clearly identified on the front of the ticket.  Ticket holders entering the wrong part of the Stadium will be required to leave the Stadium and will have no right to be re-admitted.
46             Ticket holders are only authorised to use the seat indicated on the ticket and to use the official access and exit routes for that seat.  Ticket holders are not authorised to access any other part of the Stadium and may not stand in the seating areas whilst play is in progress.
47             In the event of the ticket being transferred or re-sold at a premium or for any commercial purpose without the express prior written consent of the Club/Event Organiser the ticket will not be a valid ticket for the purposes of gaining entry to the Stadium.  In the event of such occurrence, the Club/Event Organiser has the right to cancel the ticket and retain the money paid. 
48             The ticket shall not be used as a prize in a lottery or in a newspaper or other competition without the express prior written consent of the Club/Event Organiser.
49             Tickets not purchased through the Club/Event Organiser or their authorised sales agents might be stolen or counterfeit tickets.  The Club/Event Organiser takes no responsibility for stolen or counterfeit tickets purchased from unauthorised sources.  Persons in possession of counterfeit tickets or tickets that have been reported lost of stolen will be refused entry to or required to leave the Stadium at the sole discretion of the Club/Event Organiser.
50             By using the ticket to gain entry to the Stadium, the ticket holder acknowledges that the conditions set out in these Regulations and the Rules and Regulations of The Scottish Football Association, The Scottish Professional Football League, and/or where applicable, the Regulations of FIFA/UEFA Competitions have been adequately drawn to their attention and that they are bound by them.
51             If the ticket has been acquired in circumstances where the ticket holder did not have access to the conditions detailed in the Regulations (for example where the ticket is acquired by telephone or postal order) and if any of the conditions detailed in the Regulations are not acceptable to the ticket holder, the ticket should be returned intact to the main reception Caledonian Stadium (or otherwise as directed).  In such event a refund will be paid provided the application for refund has been received at the said ICT ticket office not later than the time scheduled for the commencement of the match, enclosing the intact ticket.  For the avoidance of doubt, the use of the ticket to gain entry to the Stadium will be considered to constitute acceptance by the ticket holder of all these Regulations.
Without prejudice to any other rights and remedies available to the Club/Event Organiser, whether by way of enactment, rule of law or otherwise, in the event of a breach by any person of any of the conditions set out in the Regulations or the rules and regulations of The Scottish Football Association, The Scottish Professional Football League, and/or where applicable, the Regulations of FIFA/UEFA Competitions or of any other conditions implied or duties owed as a matter of law: –
(a)             the Club/Event Organiser has the right to refuse entry to the Stadium or require any person to leave the Stadium; and/or
(b)             where entry to the Event is by ticket, the Club/Event Organiser has the right to cancel the ticket and retain the money paid for it; and/or
(c)             where the Event is a football match, the Club/Event Organiser has the right to impose a ban on the ticket holder for one or more football matches; and/or
(d)             the Club/Event Organiser has the right to recover compensation for all loss, injury or damage suffered by the Club/Event Organiser, including, but not limited to, costs incurred in repairing or replacing damaged property of the Club/Event Organiser, loss of revenue resulting from Stadium closure and/or restriction on attendance numbers, increased costs of policing and stewarding and any fines imposed on the Club/Event Organiser by any competent authority.
If any of the conditions set out in the Regulations shall in whole or in part be held to any extent to be unlawful, void or unenforceable under any enactment, rule of law or otherwise, that condition or part shall to that extent only be deemed not to form part of the Regulations and the enforceability of the remainder of the conditions in the Regulations shall not be affected.
ALL PERSONS TAKING ENTRY TO THE STADIUM EXPRESSLY AGREE AND UNDERTAKE TO COMPLY WITH THE OBLIGATIONS DETAILED IN THESE REGULATIONS AND ANY OTHER OBLIGATIONS ARISING AS A MATTER OF LAW.
